A Corregedoria Nacional de Justi\u00e7a publicou o Provimento 191\/2025,<\/a> que uniformiza os procedimentos para a atualiza\u00e7\u00e3o de certid\u00e3o de nascimento relativa \u00e0 ado\u00e7\u00e3o unilateral. Esse tipo de ado\u00e7\u00e3o ocorre quando algu\u00e9m adota o filho ou a filha do companheiro ou da companheira mediante decis\u00e3o judicial. <\/p>\n\n\n\n

A regulamenta\u00e7\u00e3o tem o objetivo de resolver diverg\u00eancias entre cart\u00f3rios brasileiros quanto ao registro civil dos casos de ado\u00e7\u00e3o unilateral. A quest\u00e3o foi analisada no Pedido de Provid\u00eancias 0004688-63.2022.2.00.0000. A norma garante seguran\u00e7a jur\u00eddica a adotantes e adotados, facilita a atua\u00e7\u00e3o dos cart\u00f3rios extrajudiciais e resguarda direitos fundamentais relacionados \u00e0 identidade e \u00e0 conviv\u00eancia familiar. <\/p>\n\n\n\n

A ado\u00e7\u00e3o unilateral \u00e9 poss\u00edvel quando n\u00e3o consta o nome de um dos genitores na certid\u00e3o de nascimento ou este tenha perdido o poder familiar, ou, ainda, em caso de morte do outro genitor, podendo ser estabelecido um novo v\u00ednculo familiar e jur\u00eddico com o adotante. <\/p>\n\n\n\n

Nova regra <\/strong> <\/p>\n\n\n\n

A norma define que, em caso de ado\u00e7\u00e3o unilateral, a certid\u00e3o de nascimento da crian\u00e7a ou adolescente adotado dever\u00e1 ser atualizada com a substitui\u00e7\u00e3o do nome do(a) pai\/m\u00e3e biol\u00f3gico(a), pelo nome do(a) pai\/m\u00e3e adotivo(a), devendo constar, ainda, os nomes de seus ascendentes.  <\/p>\n\n\n\n

Conforme as regras da Corregedoria Nacional, os dados da certid\u00e3o de nascimento primitiva n\u00e3o ser\u00e3o cancelados. Essas informa\u00e7\u00f5es dever\u00e3o permanecer resguardadas no hist\u00f3rico do cart\u00f3rio em que a crian\u00e7a ou adolescente foi registrado originalmente. Por esse motivo, n\u00e3o \u00e9 permitida a lavratura de um novo registro de nascimento no cart\u00f3rio de registro civil do munic\u00edpio de resid\u00eancia do adotante, ou seja, a altera\u00e7\u00e3o ser\u00e1 realizada exclusivamente por meio de averba\u00e7\u00e3o no assento original. <\/p>\n\n\n\n

As determina\u00e7\u00f5es do novo provimento n\u00e3o se aplicam aos casos de ado\u00e7\u00e3o bilateral \u2014 quando a crian\u00e7a ou adolescente passa a integrar uma fam\u00edlia com quem n\u00e3o tem v\u00ednculo sangu\u00edneo. Nesses casos, o Estatuto da Crian\u00e7a e do Adolescente (ECA) estabelece como regra geral o cancelamento do registro original e a lavratura de um novo assento registral nos casos de ado\u00e7\u00e3o bilateral.  <\/p>\n\n\n\n
