Com o entendimento, a Turma condenou a empresa a pagar horas extras a um operador de ret\u00edfica em raz\u00e3o da redu\u00e7\u00e3o do intervalo.<\/p>\n<p><strong>Compensa\u00e7\u00e3o<\/strong><\/p>\n<p>O operador cumpria jornada di\u00e1ria de 8h48min de segunda a sexta-feira. Os 48 minutos al\u00e9m do tempo normal (8h) compensavam a dispensa de trabalho aos s\u00e1bados. Segundo ele, durante anos, o empregador reduziu o intervalo intrajornada de uma hora (artigo 71 da CLT) para 30 minutos com respaldo na autoriza\u00e7\u00e3o do Minist\u00e9rio.<\/p>\n<p>A CLT, no par\u00e1grafo 3\u00ba do artigo 71, permite a diminui\u00e7\u00e3o do per\u00edodo de repouso e alimenta\u00e7\u00e3o desde que haja a autoriza\u00e7\u00e3o do MT e que os empregados n\u00e3o estejam submetidos \u00e0 prorroga\u00e7\u00e3o de jornada. Na Justi\u00e7a do Trabalho, o empregado pediu a invalidade da redu\u00e7\u00e3o e, consequentemente, o pagamento de horas extras decorrentes da retirada de 30 minutos do intervalo.<\/p>\n<p><strong>Autoriza\u00e7\u00e3o<\/strong><\/p>\n<p>O ju\u00edzo da 1\u00aa Vara do Trabalho de Jaragu\u00e1 do Sul (SC) e o Tribunal Regional do Trabalho da 12\u00aa Regi\u00e3o indeferiram as horas extras no per\u00edodo em que a WEB tinha autoriza\u00e7\u00e3o do Minist\u00e9rio. Para o TRT, n\u00e3o ocorreu presta\u00e7\u00e3o habitual de servi\u00e7o extraordin\u00e1rio capaz de invalidar a redu\u00e7\u00e3o do intervalo. O Tribunal Regional entendeu ainda que o acordo de compensa\u00e7\u00e3o semanal n\u00e3o foi o bastante para desconstituir os efeitos jur\u00eddicos da portaria ministerial que permitiu a retirada de parte do per\u00edodo de descanso.<\/p>\n<p><strong>Invalidade<\/strong><\/p>\n<p>O relator do recurso de revista do operador, ministro Breno Medeiros, afirmou ser inv\u00e1lida a redu\u00e7\u00e3o do intervalo, independentemente de autoriza\u00e7\u00e3o espec\u00edfica do Minist\u00e9rio do Trabalho, quando h\u00e1 amplia\u00e7\u00e3o da jornada, ainda que mediante acordo de compensa\u00e7\u00e3o semanal.
