Segundo os ministros, se essa taxa estiver prevista para a corre\u00e7\u00e3o das parcelas, nada impede que seja convencionada a incid\u00eancia de juros de&nbsp;mora.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De acordo com os autos, foi ajuizada a\u00e7\u00e3o revisional de contrato de compra e venda de im\u00f3vel com pedido de indeniza\u00e7\u00e3o, sob o argumento de que algumas cl\u00e1usulas contratuais seriam abusivas \u2013 entre elas, a que previa a Selic como \u00edndice de corre\u00e7\u00e3o.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A&nbsp;senten\u00e7a&nbsp;julgou abusiva a aplica\u00e7\u00e3o da taxa e determinou a sua substitui\u00e7\u00e3o pelo IGP-M, al\u00e9m da restitui\u00e7\u00e3o dos valores. Tamb\u00e9m foram reduzidos os juros de&nbsp;mora&nbsp;e a cl\u00e1usula penal. O TJMS manteve a decis\u00e3o.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No&nbsp;recurso especial, a empresa vendedora sustentou que n\u00e3o h\u00e1 ilegalidade na corre\u00e7\u00e3o pela Selic, a qual visa recompor o valor da moeda e remunerar a concess\u00e3o do parcelamento.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Juros remunerat\u00f3rios e morat\u00f3rios podem incidir em um mesmo contrato<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A relatora, ministra Nancy Andrighi explicou que, enquanto a corre\u00e7\u00e3o monet\u00e1ria serve para recompor o poder da moeda diante da infla\u00e7\u00e3o, os juros podem ter tanto a finalidade de recompensar o credor (remunerat\u00f3rios ou compensat\u00f3rios) quanto a de indenizar pelo atraso no pagamento da d\u00edvida (morat\u00f3rios).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A ministra observou que, por terem finalidades distintas, os juros remunerat\u00f3rios e os morat\u00f3rios podem incidir em um mesmo contrato.
